Milieuschutz areas (Erhaltungssatzungen)
In a Milieuschutz area the city aims to preserve the composition of the resident population (§ 172 (1) sentence 1 no. 2 BauGB). Munich's statutes have no end date, but the city reviews every five years whether each area still qualifies.
What needs approval
In these areas the following need a permit from the city, for owner-occupied, rented and empty flats alike:
- Structural changes, e.g. modernising bathrooms, changing floor plans, installing lifts.
- Energy measures under the Buildings Energy Act (GEG), e.g. new windows or doors, insulation, new heating.
- Changes of use, e.g. turning a flat into an office or practice.
- Demolition or partial demolition of housing.
- Conversion into condominiums (Wohnungseigentum) needs a separate approval.
Pure repairs, an attic conversion that does not touch existing housing, and changes to non-residential rooms generally do not. The statute itself does not cap rents; the exception is buildings bound by an agreement to avert the city's pre-emption right.
How to check an address
address_report returns whether an address lies in an Erhaltungssatzung area, its name, since when it applies, and links to the official map, statute and justification PDFs. Example: Wörthstraße 10 lies in the area "Haidhausen" (since 11.03.2021).
